ADVERTISING & PROMOTIONS

  • Serves as outside advertising counsel for two international Fortune 500 consumer products companies.

  • Counsels clients on regulations affecting advertising law, promotions law, and environmental marketing.   

  • Advises clients regarding e-commerce and online policies, blogger agreements, TCPA, the Telemarketing Sales Rule, and the FTC Act.

  • Provides on-site training seminars for clients regarding FTC regulations.  

  • Advises clients on competitors’ advertisements that may be unfair or deceptive.

  • Assists clients with business promotions, including giveaways, coupons, sweepstakes and contests, and drafting rules and reviewing marketing materials for such promotions.  

  • Drafts and reviews loyalty and rewards programs for compliance with evolving federal, state, and common law considerations.

DATA SECURITY & PRIVACY

  • Assists clients with data management agreements, data protection agreements, and privacy matters – including the California Consumer Privacy Act and California Privacy Rights Act – and General Data Protection Regulation 2016/679 compliance.

  • Counsels clients on compliance with data collection, use and retention under evolving privacy legislation.

  • Provides representation on data security incidents and data breach investigation, forensic analysis oversight and notification to consumers and regulators.

  • Oversaw and completed negotiation of $20 million product sale to global consumer products conglomerate.

  • Facilitated complex resolution and completion of $30 million services sale for automotive manufacturer.

  • Prepared an international retailer for restructuring and counseled its general counsel and business team regarding data, indemnity, ongoing liability, and customer issues anticipated in connection with the deal.

  • Represented a global investment bank in its acquisition of a $2.2 billion hotel portfolio from a publicly-traded company.

  • Represented hospitality industry clients in hotel management agreement drafting and negotiation, service contracts, franchise agreements, loan documentation and day-to-day management issues.

  • Represented the largest independent hotel management company in the acquisition, development, and disposition of properties throughout the United States.

  • Provided guidance for a large casino company regarding comprehensive records retention compliance.

  • Drafted and reviewed complete suite of corporate form agreements for media and advertising company, including master services agreement, confidentiality agreement/NDA, release agreement, and freelance agreement.

  • Provided counseling and risk management strategies to international retailer in contract management oversight.


ADVERTISING & MARKETING
  • Counseled $1 billion North American retailer on rollout of e-commerce platform, related policies and compliance issues.

  • Serves as counsel for a $15 billion global company in all of its promotional and advertising issues.

  • Counseled a Fortune 250 consumer goods company in response to an advertisement challenge for alleged deceptive coupon practices.

  • Coordinating with franchise marketing team in rollout of new loyalty program, drafting terms and conditions, and integration with customer app experience.

  • Serves as outside advertising counsel to a major international sportswear retailer.

  • Coordinated, registered, bonded, and prepared materials for global food distributor's social media contest and ancillary sweepstakes.

  • Educated a Fortune 250 chemicals company's marketing and research teams on environmental marketing initiatives.

  • Assisted a global discount retailer in Facebook and Instagram promotions, including blogger agreements and endorsements and testimonials.

  • Prepared online policies for consumer products company for all facets of customer experience.

Beth founded Brunins Law in 2020.  She has been practicing law in the Pittsburgh area for 17 years after starting her law practice in Washington, DC for a few years before that.  Beth delivers comprehensive expertise in the areas of corporate commercial transactions, advertising law, data security and privacy.  Over the course of her career, Beth’s experience runs the gamut from complex contract drafting and negotiation to multi-million dollar acquisitions; national sweepstakes promotions to social media and blogger agreements; data protection counseling to data breach response.  

Recognized as a Pennsylvania SuperLawyer “Rising Star” in 2013 for attorneys under 40, Beth has received accolades for the responsive and pragmatic advice she provides to clients.  With a background and education in business, she has been commended for taking the time to truly understand her clients’ businesses, enabling her to provide clear, effective counsel in response to their legal needs.  She is a lawyer with a business mindset, considered to be part of the team with her clients.

A graduate of the University of Virginia (B.A., M.S.) and the College of William and Mary (J.D., M.B.A.), Beth has served as a Director and volunteer on numerous charitable organizations throughout her career.  She is currently a member of the Women’s Board of Pittsburgh and on the Board of Directors of Fox Chapel District Association.
